GENERAL CONTRACT TERMS

1. THE PARTIES AND ACCEPTANCE OF THE GENERAL CONTRACT TERMS:

(hereinafter also the General Terms and Conditions or GTC)

 

The party of the first part, WECAMP FUTURE, S.L, the supplier for the management of accommodation bookings at EL CAMPINGselected by the client from the list that WECAMP makes available to him/her (hereinafter also theprovider or EL CAMPING), with registered office at Avda. Diagonal 640, 5º E, 08017, Barcelona, tax identification number (NIF) B17007857, customer service telephone number 900.056.003 and email info@wecamp.net, as owner of the website www.wecamp.netpresents the contractual document that will govern the contracting of reservations through the aforementioned website.

 

The party of the second part, the User–Customer (hereinafter the user), who makes the reservation and is responsible for the veracity of the personal data given to the provider. 

 

BOTH PARTIES ACCEPT this document, which entails the user:

 

  1. Has read and understood the provisions set out herein.
  2. Is of legal age and has sufficient capacity to enter contracts.
  3. Assumes all the obligations set forth herein.
  4. Has read and accepts these general terms and conditions of purchase from the moment they realize any reservation.

This document may be printed out and kept by users. 

 

The provider makes the following email address, info@wecamp.netavailable to users for any questions that may arise about these conditions.

 

These conditions will be valid for an indefinite period and will be applicable to all contracts executed through the provider’s website, above referenced by the lender.

 

The provider reserves the right to unilaterally modify these General Terms and Conditions, without affecting the goods or promotions acquired prior to the modifications, in order to improve the accommodations offered. In any case, these General Terms and Conditions must be consulted before purchasing any accommodations.

 

We recommend keeping a copy of the data contained in the reservation

The civil liability of EL CAMPING for the services provided is limited to the value of the same. The user waives the right to hold EL CAMPING liable for any item in the event of dissatisfaction with the services purchased on the website, as well as possible failures, slowness of access, or errors in accessing the website, including loss of data or any other type of information that could exist on the computer or network of the user accessing the website.

 

 

The CAMPING offers accommodation rentals through the above referenced website.

2. PURPOSE OF THE CONTRACT:

2.1 Scope of application: The purpose of this contract is to regulate the contractual relationship of provision of accommodation by the provider under a certain price and reservation and payment thereof by the user at the time the user accepts these booking conditions during the online booking process by checking the appropriate box. These GTC shall apply from the day the reservation is made.

 

The aforementioned contractual relationship involves the provision of a service, in exchange for a specific price publicly displayed on the website, at the time of making a specific reservation.

 

  2.2 Territory of application: The possibility of booking through the website is active for all the world.

            

2.3 Capacity to contract: In order to place a reservation, you must be of legal age and have the capacity to enter into contracts.

 

2.4 Customer acceptance: The validation of a reservation through the indicated website is carried out by email and implies the automatic acceptance of the GTC. These conditions are available on the website or, if you desired and ask for, we can make them available to you by email.

 

2.5. Modification of the General Terms and Conditions: EL CAMPING reserves the right to make changes and/or modifications to these GTC. We advise our customers to review them regularly. If these changes or modifications are made after a reservation has been placed, the conditions in force on the date in which the order was placed will apply.

3. INFORMATION PROVIDED ON THE WEBSITE:

3.1 Publication of prices: The prices of the accommodations are those shown at the time of making the reservation on the website. 


            3.2 Accommodation information: The information that appears in our advertising, brochures, in other written material, on our website, or provided to you constitutes an invitation to make a reservation. The contents of the website are constantly being renewed and updated to offer our customers the most comprehensive and detailed information in Spanish, Catalan, French and English. The communication with the clients and users, as well as the formalization of the contract, will be carried out in the language that the client wishes, always indicating it before starting the contracting procedure.

 

3.3 Availability of accommodation(s): The published accommodations are available. In cases where the accommodation is not available, it will not appear on the website.

 

3.4 Reservations for the opening period of EL CAMPING: The schedule for receiving reservations via web, made for the opening period of the campsite (period reported within the page of each campsite available on the web) is twenty-four (24) hours 365 days. Once the reservation is made, you will automatically receive an email confirming the process and another one confirming the purchase when the provider has received and confirmed the payment corresponding to the amount of the reservation.

The reception and telephone service hours, during the opening period of the campsite, are from 9:00 am to 10:00 pm.

 

3.5 Fraud: If EL CAMPING suspects or detects any anomaly or fraud, it reserves the right to cancel the transaction for security reasons.

4. RESERVATION PROCEDURE:

In order to access the accommodations offered by the provider, the user doesn’t need to be registered on the website by creating a user account. Will only ask for the necessary information to process the reservation. 

 

Once the user has selected the accommodation(s) he/she wishes to reserve, in accordance with the requirements of Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will proceed using the following steps:

  1. Choose the campsite, the dates of the stay and the number of people and click on consult. The available accommodations will appear and the desired rental by clicking on select will be added to the shopping cart and you will be able to process the reservation. 
  2. The confirmation of the purchase will appear (summary of the reservation made, your data, the amount of the reservation and the method of payment).

A series of personal data will be requested in order to make the reservation, and then the user's consent to save your data is requested. If you give it, it will be saved and you will be sent information about our services and/or offers if you allow it, otherwise the data will be saved for future purchases only.

Spam and junk mail controls in your email inbox should be checked and always verify that the contact details you provide are correct.

  1. Once you have filled in your data, together with the total amount of the reservation, there is a check box that you must check since it is the acceptance of these General Terms and Conditions and the Privacy Policy.
  2. To finish the process, you must click on the Make Reservation button. 

 

In any case, once the contracting procedure has been completed, the provider’s contracting platform will inform the user by email of all the characteristics, price and payment at the establishment, contracting date, and dates of the reservation. 

 

If there is any type of error in the address given or in any other aspect of the reservation, you must notify us of this immediately using the email address that will appear on the website in order to rectify the error.

 

If you have any questions, you may contact our customer service department using any of the methods provided on the website. 

 

EL CAMPING will provide customer service for FREE through our contact email, info@wecamp.net or telephone 900.056.003 If you choose an alternative means of communication, you will be responsible for its cost. 

 

5. CONFIRMATION OF RESERVATION:

At the time of the completion of the online purchase we will send confirmation of the reservation to the email address you provided at the time of booking. Payment is made upon arrival at the establishment, 7 and 3 days prior to arrival you will receive reminder emails. 

 

If there is any error in the data you should immediately contact our customer service line 900.056.003 or send an email to info@wecamp.net, in order to proceed to the appropriate rectification. 

 

6. PRICES AND TERMS OF VALIDITY OF THE OFFERS:

All prices shown on the website include the VAT in force at the time of booking. All prices shown on the website are valid and will be expressed in Euro currency (€).

 

The invoice of the reservation will be sent to the user personally at the moment of the payment of the reservation. 

 

The prices applicable to each accommodation rental will be those published on the website and applied automatically in the last phase of the purchasing procedure. 

 

In the cases of promotions of limited duration, the discount of the promotion will be applied as long as the reservation has been registered during the promotion period. 

 

The data recorded by the different payment methods constitutes proof of the date on which the financial transactions were made and will be used to determine whether or not the reservation is subject to promotion.

 

For any information regarding the reservation, the User may contact the Provider's customer service department through the phone number or e-mail address provided. 

 

7. PAYMENT METHODS:

In the web booking process, credit or debit card information is requested as a guarantee of the reservation: the user must have a valid credit or debit card, where you must specify all the digits of the card number, expiration date and name of the card holder in the corresponding form. The transaction is formalized at the time of booking. We only accept payments with secure cards in which your identity as the card holder is authenticated according to the method established by your bank, through secure electronic commerce ("verified by visa" and "mastercard securecode"). The reservation cannot be considered and will not be processed until the payment has been authorized by your bank or cashier. 

 

We use the system called SSL (Secure Sockets Layer), a payment system in a secure environment that allows the encryption of the information transmitted during the transaction, ensuring its confidentiality.

 

Once the user arrives at the establishment, 100% of the amount of the reservation will be paid by credit or debit card. 

 

In case of cancellation outside the established period with charges or no-show, the payment will be realized using the credit or debit card indicated in the reservation.

8. CANCELLATION AND PAYMENT CONDITIONS

The right of withdrawal does not apply in accordance with the exception regulated in Article 103 l) of Royal Legislative Decree 1/2007 of November 16, 2007, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, as the supply of accommodation services for purposes other than to serve as housing if the contracts provide for a specific date or period of execution.

The cancellation policy will depend on the chosen rate and the conditions to which each of them is subject. In the confirmation of your reservation you will find the details of the cancellation policy. If the reservation has been made through a travel agency or another website, you must contact them to manage the cancellation of your reservation. After that time, if you cancel, we will charge the first night at your card. 

 

If the reserved accommodation is not occupied on the day of arrival or at the latest on the following day before 12:00 p.m., the reservation will be automatically cancelled, unless we have been notified of the delay. There will be no refund in case of delay on the day of arrival or early departure.

9. CONDITIONS OF THE STAY

The accommodation can be occupied on the day of arrival from 3:00 p.m. and must be vacated on the scheduled day of departure before 12:00 p.m. 

 

The pitch can be occupied from 1:00 p.m. on the day of arrival and must be vacated by 12:00 p.m. on the scheduled day of departure. It’s only authorized the colocation of one advance, and it’s not allowed the installation of any other type of additional fence unless the proportioned by the camping. 

 

Tents, caravans and vehicles may only be set up during the opening hours of the reception and only in the areas assigned by the Management. Changes of location must be authorized.

 

The tourist tax, if it’s applicable, will be applied according to current legislation and will be paid at the reception desk at the time of arrival.

 

Pets are allowed in EL CAMPING, except in cabin tent and glamping Couple. It is forbidden the entry in the camp of animals that manifestly pose a danger or cause discomfort to the campers. They will always remain tied up, within the limits of their plot, and their owners will be always responsible.

 

Once the reservation has been formalized, the Management undertakes to reserve the number of accommodations or plots requested, without being able to guarantee the exact location. The reservation only confers the right to occupy an undetermined place and does not confer any other privilege.  

 

The Provider shall not be liable for booking errors attributable to the user or caused by unavoidable and extraordinary circumstances.

 

Extra services:

If the USER is interested in hiring an extra service, he/she must select it at the time of booking where the conditions and price of the service will appear.

 

Responsibilities of the client:

The USER undertakes to:

  • Respect the rules of the Camping detailed in the rules of procedure that will be available at the reception and detailed in these conditions in this clause. 
  • During the hours of rest from 24:00h to 8:00h, it is not allowed to use the accommodation for party celebrations, nor make noise, nor move around the facilities. Under no circumstances is it allowed to occupy the accommodation/plot by more people than the maximum capacity established.
  • Pool hours are from 9:30 to 19:30. It is forbidden to stick objects such as parasols, awnings, etc. on the grass, as well as to use inflatable mattresses inside the pool.
  • Children must always be accompanied by their parents and under their responsibility.
  • The USER is responsible for the correct behaviour of all his/her fellow guests, otherwise, the PROVIDER reserves the right to expel the occupants of the accommodation, without the right to future claims or any type of compensation.
  • CAMPING, shall not be liable for any direct or indirect damage that may be caused as a result of the misuse of the accommodation, including without limitation: damage, loss after fire, theft, crime, accidents or other types of damage.
  • Entry to the campsite is reserved exclusively for campers. In exceptional cases, the Management, at the request of the client and under his responsibility, may authorize the entry, always for a limited time previously indicated, of relatives and friends who are obliged in any case to present their identity document. Once the time specified has elapsed, the visitor will be considered as a client for one day for all purposes. The same will occur when the visitor made use of any service of the Camping.

Recommendations:

  • To speed up departures and avoid unnecessary waiting, leave your stay the evening before your departure.
  • We request the rational use of water and facilities as well as the environment.

Prohibitions:

  • Disturbing the rest of the neighbours.
  • Practicing activities that may disturb other campers.
  • Misuse of water.
  • Introduce non-accommodated persons without authorization from the Management.
  • Damage plants, trees or camp facilities.
  • Open or tamper with the electrical supply cabinets in the plots. In case of a breakdown, go to the reception desk.
  • The use of televisions, radios or musical instruments at high volume is forbidden.
  • Lighting barbecues or wood or charcoal fires inside or outside the campsite (expressly prohibited by the Environment Agency).

 

The Provider shall not be liable for booking errors attributable to the user or caused by unavoidable and extraordinary circumstances.

10. NULLITY AND INEFFECTIVENESS OF THE CLAUSES:

Should any clause of these General Terms and Conditions be declared fully or partially null or ineffective, such nullity or ineffectiveness will only affect said provision or the part thereof to the extent that it is null or ineffective. The General Terms and Conditions will remain in force in all other respects and the aforementioned provision or the affected part thereof will be considered to have been omitted.

11. ONLINE DISPUTE RESOLUTION:

In accordance with Article 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for the resolution of online disputes between the user and the provider, without the need to resort to the courts of law, through the intervention of a third party, called the dispute resolution body, which acts as an intermediary between the two. This body is neutral and will dialogue with both parties to reach an agreement and may eventually suggest and/or impose a solution for the dispute. 12. APPLICABLE LAW AND JURISDICTION:

These conditions will be governed by or interpreted in accordance with Spanish law unless expressly established otherwise. The provider and the user agree to submit any dispute that may arise from the provision of the accommodations or services subject to these General Terms and Conditions to the courts and tribunals of the provider’s registered office (if it’s not considered a consumer for the purposes of the Consolidated Text of the General Law on the Defence of Consumers & Users (TRLGDCU)) or of the user (if considered a consumer for the purposes of the TRLGDCU). 

13. APPLICABLE LEGISLATION:

These General Terms and Conditions are subject to the provisions of: 

European regulations governing e-commerce:

  • Directive 97/7/EC on the protection of consumers in respect of distance contracts (Distance Selling Directive);
  • Directive 2000/31/EC on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market (Directive on electronic commerce).
